MISC_NOTES: Something to research later: A Thomas Harwood appears many times in the Virginia Register of elected/appointed persons serving in the House of Burgess in several positions over a period of many years. Thomas appears to represent Mulberry Island and later in Warwick River. Later in 1685 a Humphrey Harwood served. Later he was called Major Humphrey Harwood. By 1714 a William and Samuel Harwood Jr. (Charles City) served.

Richard Burt "the Elder" was born about 1665, presumbly in Virginia. No records have been found concerning the parents of Richard Burt the elder. There are records that a Richard Burt <time_earlyva.html> was living in Charles River County, Colonial Virginia in 1642 and 1649. This person was in that portion of Charles River County that later became Gloucester County. Richard married Elizabeth Hansford, daughter of Thomas Hansford and Elizabeth Jones [1] [2], about 1687 in VA. Elizabeth was born about 1670 in VA. She died after 1692 in York Co., VA. From this marriage there was only one child, Richard Burt "the younger", as evidenced by the following indenture made in January 1737/8 [1]: "the one Third part of a Certain Tract or parcell of Land Situate Lying and being in York County and York Hampton parish containing two hundred acres more or less and is now in the possession and occupation of Richard Burt the Elder which Said Land was Given by the Last will and Testament of Elizabeth Hansford the Sole heir of Richard Jones to Elizabeth her Daughter who Intermarried with the above named Richard Burt the Elder by which marriage she the Said Eliz had Richard Burtt the younger (her Sole and only heir Richard the younger Intermarried with Catherine By whom he had three Daughters VIZ. Martha Eliz and the above named Judith the wife of the said John Cosby So that the said Land (after the Death of Richard the Elder) doth descend to the three Daughters of Rich. the Younger as Co-heirs and all houses Edifices buildings orchards, pastures, woods, waters, marshes, Easements, Profits, Commodities, advantages, and ?heritances? whatsoever to the Said one third part of the Said Tract or parcell of Land belonging or in any wise appertaining the right and title of the Said Richard the Elder being allways Saved and Excepted and also the reversion & reversions Remainder & Remainders, Rents, and Services of all and Singular the premices" This deed clearly identifies Richard the younger as the only and sole heir of Richard the elder Burt and his wife Elizabeth. Further, this deed clearly identifies Elizabeth, wife of Richard the elder, as a daughter of Thomas and Elizabeth Jones Hansford. Elizabeth's father Thomas Hansford was executed in 1676/77 for his part in Bacon's rebellion. Elizabeth's life was also involved in some controversy - she was arrested and charged with assault <elizabeth_court.html> of Mary Peters, wife of Francis Peters, on 18 Jul 1692.

Richard Burt married secondly Elizabeth Moody [3], daughter of Josias Moody and Elizabeth Folliott, sometime after 1692 in Virginia. Elizabeth was born about 1676 in Viginia and died before 1745.Richard Burt was listed for 200 acres on the York Co., Virginia 1704 Quit Rent Rolls. Richard Burt died in York County in 1745.

John Longbottom was also known as John Bottom in Brunswick County. The Minister who married John

and Tabitha, also married John's sister, Sally L. Bottom(notice the L) on November 24, 1800. William L.

Bottom (notice the L) was the bondsman and John L. Bottom (notice the L), her father, was the witness.

Many

sources list his middle name as Harwood, however I have faith in the research of Ray Sasser, listed

below giving the name as Herod. Some sources: LDS and Nancy Foster. On his father's death, as

eldest son, he inherited the estate and remained there until his death. He was first married to Sela

Lightfoot in 1795 and had one daughter, Nancy Harwood, before marrying Sally Braswell.

Ray Sasser: "John Foster's middle name was "Herod," and he seems to have been known to family and

friends simply by that name-"Herod"-and not by the name John, though official documents usually use "

John." There are other people in Brunswick, not necessarily related to Braswells, with middle names of "

Herod." Why it was popular, I don't know. If the name derives originally from a family named "Harwood,"

this would not surprise me, but by the nineteenth century in Brunswick County, the given name was

always "Harod."

Another interesting name in Brunswick County that modern researchers like to alter to fit modern

ideas was the middle name of "Hutson"; people like to change it to "Hudson." That name also pops up in

the Braswell family tree."

and 6 days. Moved to Tennessee about 1824, and the following year moved to Lincoln County, Missouri.

Only four of eleven children survived him. Nancy died "about 11 years" before. He was a member of

the Methodist Episcopal Church South. (typed copy of obit provided by Barbara Longwell, rec'd 28 Jul

CENSUS: Neither Louisa nor Rosetta, who were listed on the 1850 census as part of the household,

were mentioned in the will--they may be in-laws (marriages not yet found) or, if they are daughters, they

died before1865 with no heirs since he left something to everyone else, even if he didn't like them much.

unmarked" (?unnamed) grave next to Charles Foster according to Margaret W Clare's letter (6 Aug 1993)

. She mentions Charles G and and S Charles, son of W H and M A, whoever they might be also being

in the same plot in the cemetery.

The SLC Family History Center has a microfische with the Trobaugh Family history on it. Shows

migration from Germany to Pennsylvania toTennessee. Mass migrations to Tenn came about 1780. A

second Robt L. Foster appears in Tenn after my Robert left Tenn for Ky. His name appears in above

Trobaugh history as the husband to Catherine but the dates of birth and marriage show it to be in error.

My Robert L. should be the correct husband to Catharine if another reprint is ever made. (6-25-94) glf

of Census 22 Aug 1850 and 31 Jan 1851 when Robert marries Elizabeth H. Adams.

MISC_NOTES: Mary was married 30 years, had 8 children of which 6 were still living. Mary and both

parents were born in Virginia. Daughter, Cassie was living at home with her parents.

MISC_NOTES: I suspect that James is named after his uncle who was named James Harrison Foster.

MILITARY: National Archives research center (copied by Gary Foster on 14 July 2006) contains the Civil

War pension packet for James P. Foster. In it is the application from his widow Arvilla Jane Foster

requesting her husbands pension that she might continue to raise her children in Missouri. See packet

number 210248. This packet contains about 40 pieces of paper covering the application for a pension,

the many testimonies from soldiers, officers, attorneys representing Arvilla, County Clerks, Postmasters ,

relatives and neighbors stating that Arvilla and James were married, of good character, that she had not

remarried, the number of her children, their names and ages and even the mention of a child born but

didn't survive.

MILITARY: Facts: James was a corporal assigned to Company F, 5th Regiment of the Provincial

Missouri Militia Volunteers. He died on August 28, 1863. The cause of death was being thrown from his

horse in Kansas City while bringing bread back to his command located at Westport, a distance of about

3 miles. He was assisgned to Captain Smith at the time. Testimonies of two soldiers who were on the

same assignment testified that he was not drunk but sober at the time he was thrown from his horse.

One of the soldiers said he had known of James to take a drink but had never known him to be drunk in

his life.

MILITARY: Widows Claim for Pension, State of Missouri, County of Jackson, on the 12th day of July

1873 Arvilla appeared with the County Clerk and 4 witnesses named J. W. Swearingen, H. W. Randall,

William N. O. Monroe, & Abraham Mallimon all residents of Independence, Jackson, Missouri. Arvilla

was age 44 and applied for the pension provided by the Act of Congress approved July 14, 1862. This

document stated that Arvilla's maiden name was spelled Icanberry. It names the children and their ages

but missed the correct dates of few of the children.

MILITARY: War Department, Surgeon General's Office, Record and Pension Divison, Washington D.C.

November 19 1873. Stated that James Foster was admitted to the General Hospital, Kansas City,

Missouri on Aug 25, 1863 for treatment of a Concusion and died August 28th 1863 of Concusion of the

Brain. Signed J. J. Woodward, Assistant Surgeon, U.S. Army.

MILITARY: James D. Macador testified that he was intimately acquainted with James P. Foster and after

the war Arvilla lived in the same county as he did. She had 5 children before his death and one after his

death. She was reported to be of good character and is esteemed by all that know her as a christian

lady, remained a widow and was entitled to full credit for the pension she applied for.

MILITARY: Ezra R.. Hickman knew James and Arvilla for 20 + years. She stated that her husband was

Arvilla's uncle and that he had read the record of births of the children and verified that the number of

children were correct. She said the date on the record was July 11, 1849. (this was the day before the

marriage date) Signed Lydia Ann Hickman.

MILITARY: Clerk of the Probate Court in the County of Jackson, Missouri recorded that Arvilla was

appointed guardian of the minor heirs of James P. Foster in February 1869 and has continued as such

as of the 13th day of July 1873. Signed by William W. Winship.

MILITARY: Found proof of marriage in Civil War packet # 210,248 This is to certify that I did on the 12th

day of July 1849, solemize the rite of matrimony between James Foster and Arvilla Jane Iconberg of

Jackson County Missouri according to the laws of said state. Signed James L. Porter, the minister who

performed the marriage in the M.E. Church South. This marriage is recorded in Marriage Record No. 2

on Page 209.

MILITARY: October 10th 1873 letter written for Arvilla by J. H. Baker, Esquire. Dear Sir, Some 3 months

me, Mr. Ezra R. Hickman, Clerk of the County of Jackson and State of Missouri, Mrs Arvilla Jane Foster

and being duly sworn testified as follows. I am the widow of James P. Foster that was wounded and

died in the serviced in August 1863 and am now making application for a pension for myself and the

children of said James P. Foster of which I am the mother. And I state as the mother of said children

that the record of their ages as recorded in the family bible is correct. Which reads as follows, Louisa

Francis Foster was born August 5th 1852. Delilah Elizabeth was born august 25th 1854. Laura Ann was

born September 16th 1856, James Marion was born April 9th 1859, Mary Alice was born September

15th 1861 and Arvilla James was born May 1st 1864. James Marion died September 19, 1859. Arvilla

Jane Foster signed with her (mark) X. This statement was subcribed & sworn to me this 9th day of April

1874. (Also, note that from the time of death of James P. Foster on 28 August 1863 and the birth of the

last daughter Arvilla James Foster, that his wife Arvilla Jane was only a few weeks pregnant. glf)

(Note the time delay in Washington of one year after all the paperwork was completed! Things haven't

changed very much by the year 2005! Comments by Gary Foster and not part of the Civil War packet.)

MILITARY: Henry M. Gitt, Esquire. Letter dated May 12, 1877. Dear Sir, Enclosed find the affidavit of M.

Glennan in the claim of Mrs. Foster for pension, it is No. 210.848. This is about all we can do. You will

remember that I furnished a certified copy of the family bible showing the ages of the children. Also,

affidavits of Capt. Smith, Liet. Strode, Capt. Monroe and John W. Serearingen of the same company

showing his good character. Call the attention of the commissioner to the evidence and see if you can't

get hime to grant her a pension, he ought to do it. How are you getting on with our claims? What are .....

MILITARY: Arvilla endured the miriade of paperwork that humbled her and her seven children (all girls)

to plead with the government for the pension they offered to all widows who lost their husbands during

the war. She was living in Independence, Missouri at the time of the application. It took the government

over 4 years to approve her pension.

MILITARY: A full pension was eventually given too her but she earned it. glf

BIOGRAPHY: Enlisted in Civil War as William Ervin. Later when pensions were offered to survivors he

got his brother, Calvin to verify that William H. Foster was William Ervin for the duration of the war only.

Worked for Sante Fe Railroad.

According to Mabel Foster (Hugh ErnestFoster) William H. Foster came by train from Kansas to

somewhere in Texas and then by horse & buggy to Clovis, New Mexico about 1918 or so. Hugh told

Mabel to not encourage him to stay as they couldn't afford to feed anymore. William H. stayed to

become acquainted with his grandson Hugh and his family and returned home to Council Grove, Kansas.

William H. Foster qualified for military (Civil War) medical benefits near the time of his death 5 Jun1923

and died in the Sawtell Hospital in Los Angeles, California. His body was shipped back to Council

Grove, Kansas for burial in the Greenwood Cemetery in the same plot as his 2nd wife Fannie, his sons

James and Emmett Foster. The name of William H. Foster needs to be added to the cemetery marker.

City cemetery records say he is buried here but he nearly outlived everyone in his family and his name

was never put on the family cemetery stone. I plan to add his name someday. Gary L. Foster.

In Los Angeles he stayed with his daughter, Lucille De Ruyelle. Later in life, I believe Lucille was also

buried in Greenwood Cemetery, in Council Grove, Kansas, near her parents.

I suspect the middle name listed as H. stands for Harrison named after his father Robert's brother

James Harrison Foster. The Foster family used the middle initial "H" many times in the naming of their

children.

MISC_NOTES: I used the 1880 Soundex Kansas to locate the family in Council Grove, Kansas where

they lived for nearly 50 years. glf

Scott Foster of his first marriage who was living in New Mexico and his daughter, of his 2nd marriage

William West was born on June 6, 1829 in Hopkins Co. Kentucky. He died on June 16 1909 in Mountain

View, Alberta, Canada. William, the oldest son of Hardin West, planned to become a preacher in

Missouri, but he heard of the gold rush in California and decided to go out there and seek his fortune.

Apparently he was married at the time and had a small son. His wife did not want any part of going to

California so they divided up their property and were divorced. William went to California, but it was

never learned whether or not he made his fortune. When he decided to California he came back through

Utah on his way to Missouri. He join up with a group of Mormon settlers and became a follower of that

faith. He remarried and did not return to Missouri at the time. In the mid to late 1870's William made a

journey back to Kentucky and Missouri. He kept a journal of all his travels on the way. In his journal is

recorded all the names of his brothers and sister and his parents. He named Katherine Williams West as

his mother and made records of all of her people. (His record contains birth dates, marriages and the

dates of deaths that had occurred in his family. It did not give the date his father and mother were

married.) William lived in Utah, Missouri, Idaho, and Alberta, Canada.Parents: Hardin WEST and

Katherine WILLIAMS.

He married Sarah Jane Blize on July 23 1850. He was divorced from Sarah

Jane Blize.

Found Mary Foster with her husband Lawrence S. Kurt, son Lawrence Jr, brother William Henry Foster &

sister Lydia John Foster. All were living in the same household at this time. Mary and Lawrence were

married 3 years and had one child.

MISC_NOTES: William Scott Foster lived 76 years, 9 months and 22 days. He died about the time the

United States began collecting Federal Income Tax. (That alone would be reason enough to die) glf

BIOGRAPHY: Lillie M. Moore lived only 25 years. She was born in Wisconsin and moved to Missouri

with her parents and her Brothers M.B. and Albert. Possibly her mother died in Missouri where Albert

was born. In 1880 Census Lillie is only age 14. She meets William Scott Foster, age 22 that year and

marries him on 18 Nov. 1880. She went with William from Eastland County, to Commanche County, to

LLano County, to Hail Center, Hale County, to Brisco County,Texas. She bore 6 children under very

primitive conditions. The last two girls died right away.

Family stories say she was a childhood bride (Age 14) and when she was dieing at the age of 25 of TB,

her husband William Scott Foster took her to Oklahoma where her father was living. We think she died

there.

When William returned to Texas with his four children he checked them into school. There he met and

married the school teacher Sadie (Sallie)Savage. She bore him six more children. They lived and

raised their family in New Mexico. Notes by Gary L. Foster.
